In C-581/20, TOTO, the CJEU was asked about two key aspects of Brussels I bis Regulation jurisdictional regime for interim proceedings. One is whether it possible to apply same provisional measure before courts Member States. The other access measures throughout Article 35 subject a European autonomous prerequisites. To first point, and against Advocate General Opinion, replies that such practice allowed. Concerning second does not even clarify there an prerequisites exists or not. CJEU’s answers are less ambitious than expectations generated by preliminary reference. This paper offers comprehensive analysis judgment evaluating its impact on interpretation Regulation.

A case of subretinal cysticercosis was treated with laser coagulations round the cyst prior to surgery. In-toto removal of the living cysticercus was performed by pars plana vitrectomy. Two weeks after surgery 25/20 vision was regained. Histopathology of the cyst confirmed the clinical diagnosis.
